Terms of Service — Funeral Homes

These Terms of Service ("Terms") govern your funeral home's use of Funeral Bids, a platform operated by Professional Funeral Planning ("PFP," "we," "us"). By creating an account, you agree to these Terms on behalf of your business.

1. Eligibility

You must be a licensed funeral home or hold a valid funeral director license in the state(s) where you operate. By signing up, you represent that all license and business information you provide is accurate and current. We may request documentation to verify your license at any time, and may suspend or terminate your account if we cannot verify it.

2. Account Approval

New funeral home accounts are reviewed before activation. We reserve the right to approve, reject, or delay any account at our sole discretion, including for reasons related to licensing, business standing, or platform capacity in your service area.

3. How Quoting Works

Funeral Bids allows you to view family service requests within your selected service radius and submit itemized price quotes, referred to on this platform as "bids." Key rules:

  • Submitting a quote does not mean an auction, and does not guarantee selection. A quote is simply an offered price for the family's consideration. There is no requirement that the lowest, highest, first, or any particular quote be accepted. The family may accept any quote, no quote, or end their request entirely, at their sole discretion.
  • You may submit one active quote per family request at a time.
  • You may revise your quote up to two (2) times per request. After your second revision, your quote is final and cannot be changed again for that request.
  • Every line item you priced on a previous quote for a given request must remain priced on any revised quote — you may not remove pricing for a service the family requested.
  • Quotes must reflect prices you are willing and able to honor in full if selected.
  • Submitting a bid creates no contract, obligation, or expectation of selection between you and the family, or between you and Funeral Bids, unless and until a family affirmatively accepts your specific bid.

4. Fees

Pay-per-bid (no subscription): Your first accepted bid on Funeral Bids is free. Every accepted bid after that is subject to a flat fee, charged only when a family accepts your bid. Current fee amounts are shown in your dashboard and may vary by service type.

Subscription: Funeral homes may subscribe to a monthly plan that waives per-quote fees on accepted quotes for the duration of the subscription. Subscription pricing and terms are described at the time of signup and may change with notice.

You authorize us to charge your payment method on file for any fee owed under these Terms.

5. Family Information

Family service requests are shared with you so that you may prepare an accurate quote. Family contact information is withheld until a family accepts your quote. You agree not to attempt to identify or contact a family before their quote is accepted.

6. Honoring Accepted Quotes

If a family accepts your quote, you agree to honor the price and terms of that quote in full for the services exactly as requested at the time of acceptance, consistent with all applicable state and federal law, including the FTC Funeral Rule and any applicable state funeral regulations. Families have the ability to report funeral homes who do not honor an accepted quote for the services as originally requested.

If a family adds, removes, or changes services after accepting your quote — whether discovered during your follow-up conversation or at any later point — you may adjust the price accordingly to reflect those changes, consistent with the FTC Funeral Rule's requirements for accurate, itemized disclosure. You must clearly communicate any price changes to the family and the reason for them.

7. Compliance with Law

You are solely responsible for ensuring your pricing and business practices comply with all applicable laws, including state funeral licensing regulations and the FTC Funeral Rule.

8. Account Suspension and Termination

We may suspend or terminate your account at our discretion for violations of these Terms, including license issues, dishonoring accepted quotes, or attempting to bypass the platform.

9. Limitation of Liability

To the fullest extent permitted by law, Funeral Bids and PFP are not liable for any damages or losses arising from your use of this platform.

10. Changes to These Terms

We may update these Terms, including fee structures, from time to time. Continued use of Funeral Bids constitutes acceptance of the revised Terms.
